Terms of Service

Welcome to fiveshield. These Terms of Service ("Terms") govern your access to and use of the fiveshield DDoS mitigation service, website (fiveshield.co), and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By creating an account, accessing our dashboard, or installing the fiveshield resource on your FiveM/RedM server, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. You must be at least 16 years of age to use this Service.

2. Description of Service

fiveshield provides DDoS (Distributed Denial of Service) mitigation and reverse-proxy services designed for FiveM and RedM game servers. The Service includes traffic filtering, dynamic proxy assignment, content delivery network (CDN) caching, and a web-based management dashboard. fiveshield is operated by an individual and is not a registered business entity.

3. User Accounts

To use the Service, you must create an account via Discord OAuth. You agree to:

• Provide accurate and complete information during registration
• Maintain the security and confidentiality of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

4. Billing and Payment

The Service operates on a pay-per-use model based on your daily peak player count. By using the Service, you agree to the following billing terms:

• Charges are calculated daily based on your peak concurrent player count and billed through Stripe
• Prices are displayed in Canadian Dollars (CAD) unless otherwise stated
• You are responsible for all charges incurred on your account
• Failure to maintain a sufficient balance may result in service suspension

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws, regulations, or third-party rights
• Transmit malicious code, viruses, or engage in any form of cyberattack
• Attempt to reverse-engineer, decompile, or disassemble any part of the Service
• Use the Service to protect servers engaged in illegal activities
• Resell, redistribute, or sublicense the Service without written permission
• Interfere with or disrupt the integrity or performance of the Service

6. Service Availability

We strive to maintain 99.9% uptime. However, the Service is provided on an "as-is" and "as-available" basis. We do not guarantee uninterrupted, error-free, or secure access to the Service. Planned maintenance, infrastructure issues, or circumstances beyond our control may cause temporary service interruptions. We will make reasonable efforts to notify users of planned downtime via our Discord community or status page.

7. Limitation of Liability

To the maximum extent permitted by applicable law, fiveshield and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, revenue, or business opportunities, arising out of or related to your use of or inability to use the Service. Our total aggregate liability shall not exceed the amount you have paid to fiveshield in the 30 days preceding the event giving rise to the claim.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet your requirements, be error-free, or that all DDoS attacks will be successfully mitigated.

9. Indemnification

You agree to indemnify and hold harmless fiveshield and its operator from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may terminate your account at any time by discontinuing use of the Service. Upon termination, your right to use the Service ceases immediately. Any outstanding charges remain payable.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated date. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Quebec, Canada, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Quebec, Canada.
